This is the handywork of an uninsured, unlicensed driver who fled the scene. The cops caught him and will deal with him separately, but for now I am left with this to sort out:

To say that I'm absolutely gutted is an understatement.

The repair shop wrote it off as soon as they found out that airbags had deployed

Ok so the insurance write it off you buy it back cheap & in the mean time you shop around for the parts you need & plug them up in the garage. Once you have all the parts you use the cash to get it done & get the whole car sprayed a colour of your choice :)

she probably can, but if he has nothing, she'll end up paying for it (or at least not getting anything back). I'm not sure though, it's certainly worth looking into/taking legal advice.


Even a pound a week would be something.

It happened at 06:30 this morning. I pulled off my drive and he hit me. I could see clearly up and down the road, which is a 30mph limit, so I would have seen him IF he'd been doing the speed limit. He clearly wasn't. The next thing I knew, I saw him a split second before he ploughed into me and then got a face full of airbag. He slowed down and went to pull over... and then just drove off. I didn't realise this until I'd got out the car and realised he'd gone.

The cops were there within minutes of calling and thankfully they've stopped him and busted him

Insurance company haven't said much apart from "well normally it'd be your fault because you were pulling onto a road, but fleeing from the scene won't do him much good".

Trying to find out what my options are at the moment.. if I have any. I've not admitted blame because I don't think it was my bloody fault. Why the **** was he driving unlicensed/uninsured anyway???? :(

At the moment it looks like I'll lose 2 of my 3 yr NCB and £500 excess. Some of that is covered by my loan protection.

I have a burn from the airbag and my back is really hurting. Been to the docs and got some cream for my face, but he didn't seem bothered about my back. Said it'd get better with time. If it's worse tomorrow, I'll go back.

Aww Kate, your poor car :( I can imagine how you're feeling but at least you are still in one piece.

With regards to your back, I'm sounding like a broken record and I say this every time someone posts about a car accident, but please keep your eye on it and don't take your doctors word for it if you feel it's bad. My doc said the same as yours, but I think 5 years and counting is taking the pee about getting better with 'time'.

Have you spoken to anyone about what you might have to pay etc?

The reason I ask is if he was speeding (have the cops have accident SOCOs out to check skid marks etc?) Then he's in the wrong and I wouldn't take any crap about it being your fault and losing your NCB for it. My understanding is that insurance companies pay a certain %age of premiums into a fund to cover they clients in the case of uninsured accidents and that they should be able to claim on that. I would say that fleeing the scene is pretty much an admission of liability.

PM Von or Pebs and get them to ask a jam sandwich driver about the situation and speak to someone at your insurance company with some clout because I suspect that bog standard telesales phonejockeys won't be much help.

Look after you back and don't lose sleep over it, as much as we love them cars can be replaced

Air filter and stereo have already come out. Unfortunately, the brand new beautiful clear front indicators I put on it are also smashed :(

Vix - If it feels worse tomorrrow, I'll see if I can go back for a second opinion or at least get a massage.

I don't know where I stand with regards to this MIB fund for uninsured drivers yet, but I'm going to look into it tomorrow. I don't see why I should have to lose my NCB and excess because HE was driving around with no insurance/license and going far too fast. We'll see though. Not pinning my hopes on anything ATM.

And I think if the cops hadn't caught him, Leon would have given him more than a poke with a pooey stick. Although I do have his address if you want it Dawn :p

I've just been told about this. Sending you lots of love from over here, and hope that you look after yourself. Look after your back. At least you're ok, but I know how much you loved your baby - I was the same with my bike - again an uninsured driver ****ed me over.

Don't let yourself be bullied by the insurance company - he was speeding and uninsured and didn't stop at an accident - don't let him get away with it.

I feel rubbish today. Tummy and chest ache from where my seatbelt dug in and I have a headache. Plus, my car is still dead :(

Insurance company have told me I'm not getting a hire car because they have noone to claim off. They also tried to make it all simple and say "sorry he was uninsured, it's a fault claim" until I mentioned their statement on the website that says my NCB is protected for uninsured morons. They've said it's going to be passed onto their third party claims dept, whatever that means and they'll call within the next couple of days. I don't think I'm happy with that vague answer, so I might call back and ask to speak to the more helpful bloke that I spoke to yesterday.

****ing hell, why do I feel like the crim when he was driving without a license or insurance and fled the scene? Added to the fact that he was on the wrong side of the road at the time, overtaking some parked cars at considerable speed. WHY should I have to suffer for this??? :(

Get on the phone and speak to a manager or supervisor Kate and don't let them go until you have a complete story of whats going to happen and what your rights are. The operators have a vested interest in keeping claims down and if they can get away with it they tell you its a fault claim and let you get screwed :angry:

Insurance companies *will* take the pee. It's how they make profit, by ot paying out unless they really have to. Keep at them.

Did you have an agreed value on your car? We got really shafted with the Mini cos we didn't, and they basically went through Autotrader to see how much they went for. That week there happened to be a cheap shed on for about £250 so that's what they reckoned we could replace Oscar for. Keep your eye out for similar cars for sale and keep a record of them, or try and get a Club Committe member to write a letter stating the value. Sorry if you already know that :)

I also think you should go back to the docs.

I have gap cover on my loan, so if they don't pay out I will get the difference. I thought I was being ripped off by agreeing to take out loan protection at the time, but in hindsight I am SO glad I did.

Hire car was just never going to happen, so I've sorted myself something out for work next week. Just need to get something sorted for the longer term now. My brother's 306DTurbo is an option, but it needs an MOT and we don't know how much work that involves. Will just have to suck it and see.

They're taking the car away :( I have absolutely no choice in the matter. The salvage place are under strict instructions not to touch a THING until the claim is resolved and I have made my decision on whether I'm buying it back or not. They have also agreed that as I didn't use my recovery after the accident that I will get it delivered free if I do decide I want to buy it back.

Every time I look at it, it upsets me even more. I hate it being sat there in such a mess. WHY did he have to be driving down my road at 6:50 on Wednesday?? Why did he hit ME? If he hadn't been breaking the ****ing law, I'd still have my car :( :( :(

Just been reading through the gap cover form... and I can only claim it if I'm actually settling the loan with the money the insurance company pay me. That means I will have precisely NOTHING left with which to buy a new car unless I take out another loan, which is highly likely to be a higher interest rate given the current state of our economy. Balls :(

Can't remember exactly who it was with because it was a while back but basically I'd just started self employment and thinking on my feet that the loan might get me in financial difficulty if anything went wrong I thought I'd take out this 'gold' cover which was the top cover that paid out in any circumstances, whatever went wrong. Or that's how it was sold.

My bike got stolen and the insurance refused to pay over a dispute with my CBT which I didn't know I needed for a 50cc but the law had changed. Either way it was irrelevant to a theft claim but the insurance company cover themselves with small print that gets them out of it. Then the gap cover refused to pay as well. Some of their small print was worded in a way that was basically the same as what you just described, so no payout or refusal = no pay off loan.

It's all a big con and I'll never take out any kind of loan insurance again unless it's life insurance on a mortgage. I'm just lucky it was only about £2K but at the time it was £2K I could have done with NOT losing. I paid it off with a graduate loan which was a much lower APR at the time and saved me a couple of hundred pounds over the loan period.

Absolutely everyone has told me to refuse their first offer no matter what. It was in excellent condition with a FSH and it was a desirable car in the most desirable colour too. I'm going to try and get a bit more because an extra £400 would REALLY help me along the way to getting one of the same age/condition, but I won't be too upset if I don't get it because I still have a reasonable amount.

I was really worried about the gap insurance because of what Johnny said and because it only paid the difference between the outstanding loan and the insurance payout, so I'd lose the £1k I'd already paid off. Thankfully, I don't have to worry about that anymore because I needed £3000 to break even and I have that. Phew!

I've also been talking to someone who's in the Insurance industry and he's said that he thinks I have a good case because the other driver was on the wrong side of the road overtaking parked cars at the time of impact and should have been driving with due care and attention. He didn't brake at all, which indicates that he was going too fast. This isn't helped by the fact that he buggered off. I'm not getting my hopes up, but it's made me feel slightly more positive than I was. Fingers crossed!

They are for people who has been in an accident against uninsured drivers, you will get some compensation in the claim, not as much as you would if the other driver is insured but it is at least something. It sounds to me you have some whiplash injuries to neck and lower back. From my experience (not personal, but cases that i dealt come across), it can take from a few weeks to months to resolve, depends if you go onto some physiotherapy treatment. Taking some anti-inflammatory medicine usually helps.

I do realise it has been over a week since it happened, i hope you are feeling better and no long term problems from the accident. :)

At the moment, the MIB don't need to be involved as the car was insured... just not for him. If the owner's (his gf) insurance company won't pay up, I'll have to go to the MIB. Have already rung them for advice and they were extremely helpful :)

I went to the docs about my back and he said it'd take a few weeks to settle down. I've started back at the gym now and it's flared up a little bit, but it's mostly OK. The only time when it hurts consistently is when I'm in bed. I've stopped taking Ibuprofen/Paracetamol, but might start taking Ibu during the night because I keep waking up and having to move around. Will give it a go tonight and see if it makes any diff.

Anyway, thanks for all the well wishes guys. Will keep you updated.

Just a quick update. I had a letter yesterday to tell me that the guy who hit me has had a court summons. He's up for driving without a license, failing to stop and driving without insurance on 27th May. What do you reckon he'll get? Smacked bum and £20 fine, payable in 500 monthly installments of 4p? :angry:

My back got much worse a few weeks after the accident, so I've had a couple of sessions with a chiro which has made a massive difference. I actually got my first whole night's sleep without waking up due to it hurting on Saturday :)

On the insurance front, I'm still wrangling with the insurance company over the payout and the guy dealing with the third party claim has had no response from the insurance company of the girl who owned the car. They reckon that whether she gave him permission or not, the insurance company has to pay out, but we'll see. Fingers crossed!

In other news, I really miss my car :'(:'(:'(

They're trying to put a third party claim through them first because if she gave him permission then they have to pay out. If it doesn't happen then we have to go down the MIB route which apparently will take forever. The other insurance company hasn't responded yet though so it's not looking too great. Also, there may still be a fight about who's to blame so I may end up getting sweet FA back :( Just got to wait... and wait... and wait... and WAIT :(

Update! Got the extra £400 that I wanted and have settled at that. Just waiting for the money now.

Not everyone will have read the Lopkat Pad thread so I'll say it here too. Due to me losing 2 yrs NCB (meaning I now have 1) indefinitely whilst this mess is sorted out added to the soaring costs of petrol etc., I've decided that I can't afford to buy/run another SX. I need to be sensible with the money, so I'm going to buy a £500 car to get me to work/back cheaply and spend the rest on a much-needed kitchen because our mortgage deal is up in Oct and we need to add value to the house.

Had my last chiro appointment tonight. Back feels better than it did before I had the accident :)

Still no response from the third party insurers. They have until 9th July to respond before my insurers can start legal proceedings against the driver.

I really do NOT know why I even bothered to pay my motor insurance this year. Court fine costs less than my sodding excess. I just want to scream in someone's face at how unfair this whole process is. £300??? FFS! They might as well just have not bothered. I turn out to be the one who loses out completely here, even though he should never have been on the effing road in the first place. I'm SO SO SO unbelievably angry. :(

Lostkat, have you consider taking this through the Civil Courts? Since you are insured, your insurance company could bear the legal costs in the matter and sue the guy for damages. The guy prob won't have any money and never will have but its just a thought.

It's an option that we might go down, but it's too early to tell at the moment. They have to chase the insurance company of the car (his GF's insurance.. didn't cover in) for 3 months first, then they persue him and finally they go to the MIB. At the moment I'm just assuming the worst, so if I ever get anything back then it'll be a bonus. I'm currently about £800 down (excess, chiro, hire car) and have lost 2 yrs of NCB, so anything would be progress from here.

They've sent me absolutely nothing to let me know what's going on and it's been nearly 4 months. I'm really fed up with their shockingly awful service.

Still driving around in my brother's knackered old 306, but I'll have to get something cheap soon as the clutch is on its way out and the rear beam is shot. It'll most likely be a £500 Mondeo. Ho hum :)

If it's any consolation, although usually a slow and drawn-out process, once the insurance position is sorted the MIB or their insurers will re-pay your excess and should cover any medical fees you've incurred as well.

I would keep pestering your insurance company for updates and progress, give them a prod, if they give you a date by which they await a response, diarise it yourself and if it passes without any info, call them up and chase.

In my experience MIB stuff needs the insurers to do a fair bit of chasing too and they're usually treated as low priority by the insurers, so if you're regularly phoning up for updates they should bump you up to get you off their backs :p

Good that you are in good health and it could have been worse.

As for the uninsured driver and comments about the justice system, that is why I am very disillusioned with the job after 8 years. Banned from driving when he can't legally drive and for 28 days. Welcome to the world of magistrates who have as much use as the pope's knackers and dish out weaker than piss sentences to real menaces and dangers to the public.

6 months on and still absolutely nothing has happened on the insurance front. Everytime I chase them, they're playing the waiting game for one piece of info or another. I certainly won't be paying the extra £20 odd they charge you for legal expenses again. Waste of bloody money!

I'm not sure if I mentioned, but I wrote to the police to express my disappointment at the outcome of the court case and inefficiency when dealing with the case amongst other things. I got a reply today. It's nice that they responded, but the general jist of the letter is that they empathise with me, but can't really do anything.

There are guidelines which Courts have to follow with regard to the level of income and seriousness of the case. These are set nationally. Obviously administrators are unable to comment upon judicial decisions.

Your point regarding the investigation is understood by the Police. They have to decide upon the allocation of resources and as you point out in your letter, difficult decisions have to be made.

I have made enquiries as to who had the duty to inform and undertake the clearing of the debris. It is for the Officer to notify 'Street Cleansing' at the Council. I am sorry to say that I have been unable to get to the bottom of the breakdown in communication.

It just makes me SO bloody angry that scum like this are allowed to get away with it. SIGH!

Anyway, I bought myself a car yesterday so I'm back to the joys of motor ownership again. I know most people would say "but it's only a car", but I've missed the SX like hell for the past 6 months. I really don't think I'll have another car I love quite as much as that one. Hopefully the new one will bring me a bit of closure though... it's a hoot to drive :D

Only just read this, and really sorry for you, I have some idea how you feel.

Many years ago, someone wrote off a car of mine parked in the street outside my house at about 3am on New Years Day. My insurers eventually settled about 8 months later. I have no idea what happened to him but I was certainly never told that he was even prosecuted - I left to work abroad shortly after this happened.

The driver was insured with "Clover Leaf Insurance". When I told the Police about this they roared with laughter. I asked the Desk Sergeant what was so funny, he pointed out of the windows and said that one third of the cars passing were uninsured. Foolishly, I asked why the Police didn't do anything about it, he just laughed and said "Priorities".

You would think that with modern technology (CCTV & ANPR), the Police would be able to chase up some of the thousands of cars on the road that are uninsured, untaxed and that have no MOT.


I hope your back is better and am glad that you weren't seriously injured; cars can be replaced, lives can't.
