Correct. Even if you own the original game, you're not allowed to own the rom, simply as it's not legal to make a backup of the original game. As the rom is already illegal, distributing it becomes illegal, as does downloading it. I still believe it to be a very stupid law (not being able to make a backup of software that you own), but it is indeed the law.
