I dont think its down to the hosting costs, no way would it cost £25k per year, but the amount of money and potential sales they have lost since this has been going on.

If it's true, then any attack of this type is illegal and whoever is responsible should be fined and/or jailed. Have a little mischievous fun with your online activities by all means, but costing someone money is a different ball game IMO.
However, given their less-than-honest approach in the past I'd say that it's by no means certain that a Denial attack is the cause.

These types of attacks are horrible and can be massive and extremely difficult to sort out

Max sentence for instigating a DDoS attack went up to 10 years in 2006.

Someone is gonna get a royal ****ing if they get caught.
