About the MMS issue? Nah. Works fine on my k800i with the same sim. Definitely the phone.

The phone did come with the contract yeah, an upgrade. How do you prove its broke and not just a Motorola feature?

phone them, you've already determined that the phone isn't working, it's up to them to fix it or replace it.
