Default Phones and SIMS and stuff

Right I'm not sure where Aitch stands with her mobile contract maybe someone can clarify.

A while ago Aitch got a call from Orange offering to upgrade her phone free of charge and said yes and they sent her a phone telling her she had to put the new SIM in it to activate it. Since then its been sat in the cellar whilst she used her old phone, probably two months since it was delivered. We never put the SIM in!

Now I think that they sent her the phone to tie her into another contract but she can't remember them telling her that, shes a busy woman and phones aren't really a priority for her. My question is, if we didn't put the SIM in then did we actually accept the new contract?

I'm trying to get her to use the iPhone, something like that would be ideal for her because of her using the train and underground all the time and also because her internet is locked down pretty tightly at work

Contract upgrade phones (especially free ones) come with an automatic contract tie-in. Minimum 12 months and with current contract offers it could easily be up to 24 months. I know of no exceptions to this rule (other than being a business customer, where an entirely different set of rules apply).

The question remains, if the phone hasn't be activated with the SIM that was sent with it is she tied into the contract?

Yes. Activation of the SIM is not a condition of accepting a new contract. The operator sent you a new phone and they still have to recoup the cost of that phone.

Have a look at the bill for the months immediately before and after the new phone agreement. That will likely confirm this answer.

There is still a (slim) chance that you might get lucky if they 'forgot'. Don't rule it out - when I switched tariffs several months back they forgot to remove the old details from the account, so I now pay the new tariff price and get the old (more expensive) one free.
