Default unfair dismissal?

anyone got any ideas if this is worth following up with a lawyer?

getting towards the end of my consultation period for my role. finish on Tuesday. really really looking forward to it actually.

discussions over the last few days have been about the restructure after the current guys are made redundant.

teams are getting rejiged, and my role is getting twice as much work, so half as many people. as such 3 were made redundant, and 3 were kept on.

now it looks like they're keeping 4 of my role. one of the guys that's getting the role is currently seconded to it to fill in a gap. as far as i was aware the first thing that should happen when redundancies start for a role is that anyone seconded there gets moved back to their old position?

I don't think that is the case though I certainly wouldn't quote me on it.

How long have you been with the company? Are you still on a probabtion period?

Just to confirm, they have made your position redundant and seconded someone in from another department to fill it?

Is the role exactly the same as when you did it? (Job title, responsibilities etc)

been here 3 years.


the secondment was before the redundancies came round. Paul was doing the role to fill for someone who had been seconded elsewhere.

they've cut the role to 4 positions from the 8 that it was. though the point i was rasing was that 1 of the 4 who is staying on to do the role was never given the role in the first instance.

the title is exactly the same, though the role is changing marginally to cover twice as many staff as in the past (hence the need for half the original people)

I'd say no case (from a totally unprofessional point of view). They've made you redundant but haven't replaced you. They've obviously left the other guy in the team knowing that they can shift him back to where he came from to reduce the team again if they need to.

phoned ACAS and the nice lady said there is nothing we can do just now as the plans are proposed, but after i leave if they are implemented in their current forms i will likely have a case for unfair dismissal as they have made me redundant unnecessarily.
